About this policy

This policy explains how FITNESS LAB WELLNESS PTY LTD, ABN 28 641 553 997, trading as FitnessLab (“FitnessLab”, “we”, “us”), collects, uses, stores and discloses your personal information. It covers our website, our studios in Mosman, Cammeray and Northbridge, our online coaching, and our emails and messages.

We handle personal information in line with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. Because we collect health information, we treat it as sensitive information and give it a higher level of protection.

What we collect

Depending on how you deal with us, we may collect:

• Contact details: your name, email address, phone number and preferred studio.
• Health and fitness information: such as your age, sex, weight, training history, goals, injuries and health conditions you tell us about, movement screening results, body composition measurements and progress notes.
• Calculator answers: the answers you give in Your Starting Point, our strength and nutrition calculator, and the results it produces (other than your answers to the health-screening questions, which we do not collect; see below).
• Membership and payment details: your membership, bookings, attendance and billing information. Card and bank details are handled by our payment providers, including Ezidebit and Stripe, and are not stored by us.
• Website and marketing information: how you use our website and respond to our emails and ads, collected through cookies and similar tools (see below).
• Photos and testimonials: only when you have given us permission to use them.

How we collect it

We collect information directly from you when you fill in a form on our website, use our calculator, book a Goal Mapping Session, join as a member, attend a session, message us or talk to our team. We may also collect information from a health professional you ask us to work with, with your consent. We only collect health information with your consent and where it is reasonably necessary for us to provide our services to you.

Health-screening questions in the calculator

Your Starting Point asks some health-screening questions to check whether it’s safe to give you general guidance. Your answers to those questions are used on screen only and processed in your web browser. They are never sent to us, our service providers or our analytics or advertising tools, and are not stored.

Why we use your information

We use your personal information to:

• respond to your enquiries and book your Goal Mapping Session
• send you your calculator results summary
• assess your needs and plan, deliver and adjust your training and nutrition coaching safely
• manage your membership, bookings and payments
• send you updates, tips and offers, where you have agreed to receive them
• improve our website, services and marketing
• meet our legal obligations.

We only use your health information to provide our services to you, or for another purpose you have agreed to or that the law allows.

Marketing

If you agree to hear from us, we may send you emails and messages about our services, events and offers. You can unsubscribe at any time using the link in any email, by replying STOP to a text message, or by contacting us. We will not use your health information for marketing unless you have expressly agreed to it.

Who we share it with

We only share your personal information where needed to run our business, including with:

• Our team: coaches and staff who need it to look after you.
• Service providers and cloud-based software providers: who store and process information on our behalf to help us run FitnessLab, including our customer relationship and email platform (ZipLeads), our booking and member management system (PT Minder), our website host (SiteGround), and our payment providers (including Ezidebit and Stripe). They may only use your information to provide their services to us.
• Analytics and advertising providers: Google and Meta, which collect information about how you use our website through cookies and similar tools on our site (see Cookies and analytics below). They may also use that information for their own purposes under their own privacy policies.
• Health professionals: such as your GP or physiotherapist, but only with your consent.
• Others where required or authorised by law.

We never sell, rent or trade your personal information. Other than the website information collected by our analytics and advertising providers, we do not share personal information with other businesses for their own marketing or other purposes.

Overseas storage

Some of our service providers, and our analytics and advertising providers, may store or process information on servers outside Australia, including in the United States. Where our service providers do this, we take reasonable steps to make sure your information is protected to a standard consistent with Australian privacy law.

Cookies and analytics

Our website uses cookies and similar tools, including Google Analytics and the Meta Pixel, to understand how people use the site and to measure and improve our advertising. This may include showing you our ads on other websites and social media. We do not use these tools on our calculator page, and they are not used to collect health information. You can manage cookies through your browser settings, and opt out of personalised ads through your Google and Meta ad settings.

Keeping your information secure

We take reasonable steps to protect your personal information from misuse, loss and unauthorised access, including restricting access to staff who need it and using reputable, secure systems. If a data breach is likely to result in serious harm to you, we will notify you and the Office of the Australian Information Commissioner as required by law. We keep information only for as long as we need it for the purposes above or as required by law, then delete or de-identify it.

Accessing and correcting your information

You can ask to see the personal information we hold about you, or ask us to correct it, by contacting us using the details below. We will respond within a reasonable time, usually 30 days.

Complaints

If you have a concern about how we have handled your personal information, please contact us first so we can try to resolve it. If you’re not satisfied with our response, you can contact the Office of the Australian Information Commissioner at oaic.gov.au.

Under 18s

Our services are designed for adults. We do not knowingly collect personal information from people under 18 without the consent of a parent or guardian.
